When shopping, be aware that…
- A merchant can have any type of return policy it wants. For example “all sales are final,” “merchandise credit only,” ”cash refunds within 30 days” are all acceptable. But, the policy must be disclosed clearly and conspicuously before the purchase is made.
- If the product is defective, the seller must refund, replace or repair the product at no cost to you.
- In Massachusetts there is no general right to cancel a contract within three days. Exceptions are if the contract is signed at a place other than the merchant’s usual place of business, timeshare purchases, health club memberships, and mortgage refinancing.
- A seller is required to have an adequate supply of goods that are advertised to meet the expected demand. You have the right to a rain check, which must be honored for 60 days after the advertised items is back in stock.
